Description

People live longer and retire with greater wealth than they used to.Increasingly, it is necessary for individuals to rely on and trust others to manage their financial affairs. This can often arise in the context of family
members caring for ageing relatives or assisting the elderly to move into supported accommodation.This session investigates the issues that can arise in the context of the fiduciary relationship that often exists between the elderly and their children, and identifies mechanisms that might better protect those involved.

This session will explore:

  • financial consent and capacity of the elderly;
  • property transactions;
  • Aged and Infirm Person’s Property Act 1940;
  • the relevance of habeas corpus and the liberty of the elderly;
  • powers of attorney;
  • the importance of expert evidence; and
  • undue influence and the elderly,

and will refer to

  • Western v Male [2011] SASC 75
  • BC v Public Advocate & Ors [2018] SASC 193
  • The Public Advocate v C,B [2019] SASCFC 58

Advisors of elderly clients, individuals with complex family dynamics and those involved in estate planning who would like to enhance their understanding of the potential issues.
