Topic: Commissioner of Taxation v Carter

The recent High Court decision in Commissioner of Taxation v Carter resolved two issues of significant interest to trust lawyers. The first issue is the income tax treatment of retrospective renunciations of beneficial interests in trusts. The second issue is the doctrinal nature of retrospective renunciations of beneficial interests in trusts.
