About the topic

In September 2022, the U.S. Department of the Treasury's Financial Crimes Enforcement Network (FinCEN) issued final regulations to implement the Corporate Transparency Act (CTA). The CTA establishes a national database to collect information about certain domestic and foreign US-registered legal entities, their beneficial owners, and the persons who created the entities. Estate planners will need to know the CTA rules to advise their clients as to whether the CTA applies to them (or to the attorney who filed formation documents), and if so, when and how to report their beneficial ownership in the 'reporting companies' covered by the CTA.
