Attacks on trusts by divorcing spouses continue to be a growing trend in Hong Kong. What are the disclosure obligations of beneficiaries within ancillary proceedings and what approach ought trustees take to requests for the provision of trust information? Stacey Devoy (Partner, Howse Williams) and Rita Ku (Partner, Withers) will summarise the procedure and content of the disclosure process, the timeframes in which material must be provided and the extent to which the Family Court will permit a detailed investigation of trusts prior to the setting down of a final trial.
