The current pandemic has brought an increase in the number of people making wills, many of them homemade. However, many of these Wills can be badly drafted and fail to deal with all the assets that a person has, particularly their digital assets.

Debra Burton, Legal Director in the Contentious Trusts and Probate Team at Shakespeare Martineau and Ashley Blood-Halvorsen, a specialist contentious probate and estates Barrister at 3 Paper Buildings, discuss the common problems encountered with badly drafted Wills including construction issues, the risk of full/partial intestacy, validity concerns, unintended IHT consequences and the risk of litigation. They also explore the risk of unclaimed assets coming to light at a later stage, particularly digital assets and how this can impact on the estate administration.
