Family Lawyers often encounter parties who have separated where a significant proportion of the marital assets are held in a trust. As the trust is a separate entity, the question arises whether the trust should legally fall within the definition of ‘property’ as defined in the Family Law Act.

There is an increasingly large body of matrimonial case law that deals with trusts in family law.

Dr Steven Cohen is the Managing Associate for the Family Law team and works both in our Albany and Perth offices.

Dr Cohen’s practice encompasses a broad range of matters including: children matters, financial matters, child support matters, spousal support applications and relocation cases.

Dr Cohen has a particular interest in complex child related matters and spousal maintenance applications and is an Independent Children’s Lawyer.
