There are a multitude of factors to consider when you have an estate planning client who has foreign beneficiaries and/or assets outside the jurisdiction. This presentation will cover some of those factors as follows:
- why it is important to consider the tax residency of a proposed executor
- the Australian tax consequences of having a non-resident trust estate
- CGT Event K3 and foreign beneficiaries
- testamentary trusts and foreign beneficiaries
- key foreign concepts that affect estate planning (with illustrations of cross-border issues in estate planning)
About the speaker:
Sally Bruce has over 20 years' experience in succession planning and works closely with clients to develop tailored plans, including multi-generational solutions for the firm's high net worth clients. Sally's succession planning practice is complemented by her work in the area of estate litigation. Her practice in the area of contentious estates assists her to identify potential pitfalls at the planning stage and to minimise the risk of a future challenge. Apart from succession planning and estate litigation, Sally also practises in the areas of trusts, deceased estates and guardianship and administration. Sally is a member of the Law Society of WA and the Society of Trust and Estate Practitioners. She is also Chair of the Law Society’s Elder Law & Succession Committee.
