A guide to insolvency in estates and trusts. 19 April 2023
On Wednesday, 19 April STEP Manchester is delighted to welcome Ashleigh Robinson-Beaumont of Irwin Mitchell to present the next in the series of Briefings. The session will be held via Zoom and those intending to attend are required to register before they will be provided with the log-in details.
A Guide to Insolvency in Estates and Trusts, including where: Personal Representatives, Trustees or Beneficiaries may be subject to an IVA or Bankruptcy.
Ashleigh will discuss what needs to be considered when:
- an estate is insolvent, and
- where a trust would appear to be insolvent (whether on a cashflow basis or a deficiency of assets)
In respect of the later she will consider the extent to which the Privy Council decision in Halabi v. Equity Trust might inform the trustees’ decisions.
Ashleigh will also consider:
- what should happen if a personal representative or trustee is subject to an IVA, or bankrupt when they first act/are appointed, or become subject to insolvency proceedings once they are already acting, and
- where a beneficiary is subject to an IVA or bankrupt, how does the PR or trustee determine to whom they should account for the beneficiary’s entitlement
Ashleigh is an Associate in Irwin Mitchell’s Restructuring and Insolvency team. Ashleigh specialises in contentious personal insolvency, advising and acting on Court proceedings for both insolvency professionals and individuals.
Ashleigh regularly provides advice and representation for individuals affected by their partner’s / ex-partner’s bankruptcy, as well as for individuals (e.g. surviving spouses, Executors, etc.) affected by insolvency issues arising out of deceased estates. Ashleigh also provides advice on how to deal with companies left behind by deceased individuals.
In addition, Ashleigh provides advice to individuals contemplating bankruptcy, advising on the likely impact of bankruptcy on e.g. asset bases, ongoing Court proceedings, etc. Ashleigh also advises individuals on how best to wind up their businesses, both when those businesses are/are not insolvent. Ashleigh also advises and acts for bankrupt individuals seeking annulment of their bankruptcy.
Prior to joining Irwin Mitchell in 2016, Ashleigh was a County Court Advocate with a civil litigation practice for a number of years and continues to represent clients at Court in her current practice.
