The Administration Amendment Act 2021 makes the most major change to the intestacy provisions of the Administration Act 1903 for over 30 years. The importance of these changes should not be underestimated in a State where almost one third of the persons who die each year die intestate or without a will. The changes benefit the surviving spouse. Population statistics reveal that the surviving spouse is often the female partner in the relationship. Surviving parents who often help their children buy a home also receive long-overdue recognition.
Intestacies often bring difficulties for succession lawyers.
