Join STEP New York at our November 6 Luncheon with Geoff Kertesz, Partner, Trust and Probate Litigation at Stewarts in London.

In his presentation, Geoff will discuss, among other topics, that in the UK and other overseas jurisdictions trends are emerging that may lead to a greater volume of and complexity in disputes concerning trusts and estates. These trends are caused by both the changing attitudes and demographics of trustees and the actions of the courts themselves. An important trend is that courts have shown a notable willingness to look beyond the form of trust instruments and consider the practical effect or application of provisions and the wider context of the offshore trust industry.

Geoff will also review that recently we have seen not only the establishment of trusts challenged on the basis of lack of capacity but also decisions made by trustees and power holders based on similar capacity issues.

About our speaker

  • Geoff Kertesz, Partner, Trust and Probate Litigation, Stewarts, London

Geoff's experience consists entirely of dealing with complex litigation relating to trusts and estates, often with an offshore element. He has experience with cases involving the UK, US, Channel Islands, Cayman Islands, BVI and Hong Kong, among other jurisdictions. Unusually for a litigator, Geoff acts as a trustee, which gives him a first-hand view of the issues facing trusts and trustees.

Geoff specialises in resolving troublesome issues relating to trusts and estates, whether domestic or international. Chambers describes him as a "real superstar". Geoff is dually qualified in England and Wales, and California. He was a litigator in San Francisco before cross-qualifying and relocating to London.
