It is all well and good to tell the client that proprietary estoppel equity is inchoate and that the court will do the minimum equity to do justice but what does that actually mean in practice? In this interactive session, by reference to the case of Guest v Guest, Philip Jenkins shares his thoughts about the vexed question of what it is that the court is trying to do when satisfying a successful claimant’s equity and how that translates into giving clear and useful advice to a client.
