Putting the Lawyer at the Heart of Capacity Assessments

Event Focus

Client capacity is a hot topic. It is increasingly in the news, in judgments and in the cases on our desks. It is a topic that is not only difficult but often controversial: how to raise it with the (prospective) client? What to say if s/he or their family disagrees? When/how to instruct a medical professional? What to do if a client loses capacity after instructing you?

These are issues that affect lawyers around the world and this event brings together experts from several jurisdictions to: discuss the role of the lawyer in determining capacity, provide invaluable guidance to ‘substituted decision-making’ in the UN Convention on the Rights of Persons with Disabilities and, to the relief of all, how to minimise exposure to litigation. This specialist conference aims to put the lawyer at the heart of capacity assessments and give practitioners increased confidence when dealing with capacity issues.
