Topic: Non-resident beneficiaries in the estate plan – a thorn in the side?

We live in a global and multicultural society where most families will have members who may either be non-Australian tax residents or non-Australian citizens which may have unintended consequences in the estate plan. Paul will review:

  • Federal and State legislation including CGT, stamp duty and land tax liability
  • Tax issues with trust distributions to non-resident beneficiaries
  • Tests for determining residency
  • Practical advice for clients
  • Reviewing and updating trust deeds
