This session focuses on the treatment of trusts in the event of divorce or death from a Swiss law perspective. After a short introduction to some important principles of Swiss matrimonial and succession law relevant to settlors, beneficiaries and trustees, you will be provided with an overview on:

  • the impact of trusts in relation to alimony and matrimonial property law claims
  • the impact of trusts in relation to forced heirship claims and the duty of "hotchpot"
  • recent case law in this field.

Andrea Dorjee-Good, Certified Specialist SBA Inheritance Law, TEP

Andrea Dorjee-Good is a partner at Schellenberg Wittmer in Zurich where she heads the Private Wealth Group. Andrea has extensive experience in the field of inheritance and foundation law. She advises private clients on all aspects of domestic and international estate planning, including in particular on lasting powers of attorney, wills, succession pacts and matrimonial property agreements. In addition, she assists clients in relation to asset structuring, trusts and foundations and regularly represents clients in probate matters as well as in complex trust and estate disputes.
