Description

Event Focus:

British people frequently have a connection with Spain - whether it is spending time there on holiday, owning a second home, or moving there for work or on retirement. Where someone who is the settlor or a beneficiary of a trust moves to Spain from the UK, or a trustee purchases Spanish real estate, the mismatch in the way in which assets held in trust are treated in Spain and in the UK can lead to problems for the unwary when dealing with succession matters.

In terms of succession tax planning, what happens when a settlor or a beneficiary of a trust moves from the UK to Spain? Or the trustees choose to purchase real estate or other assets in Spain? What are the compliance obligations on the settlor, beneficiary or the trustee? How does the UK and Spanish inheritance tax treatment of the trust assets interact?

These issues will be addressed by speakers Guadalupe Díaz Súnico, Barcelona-Spain and Laurence Morgan, London-UK who both specialise in cross-border estate planning.
