  • Have an understanding of the Mental Capacity Act (2005)
  • Understand the five principles of the Mental Capacity Act (2005) and how to apply them in practice
  • Understand the ‘two-stage test’ as an assessment framework and how to apply it

Part 2 Threshold of understanding and fluctuating capacity
By the end of this webinar you will:

  • Know how to define the threshold of understanding
  • Know how to apply the CMSL (Concepts/Mechanics/Short Term/Long Term) model and set the threshold of understanding
  • Understand why setting it at the right level is so important
  • Have some knowledge of case law relating to the threshold of understanding
  • Have learnt how to manage fluctuating capacity
