Program Description:

Tax transparency has become ubiquitous. First, there was FATCA and IGAs, then the OECD Common Reporting Standard (CRS). Now, the EU has introduced a new EU Directive (DAC 6) that imposes mandatory disclosure of information by "intermediaries” with respect to potentially aggressive tax planning schemes with an EU cross-border element.

DAC 6 becomes effective July 1 2020, but requires intermediaries to monitor their cross-border arrangements as of June 25, 2018.

This Directive will have far reaching consequences for a broad array of private client wealth planners, including tax advisors, accountants, bankers, other services providers, as well as taxpayers.

Our panelists will overview the elements of DAC 6, provide a comparison to existing US mandatory disclosure rules, explain when foreign tax planning may implicate US criminal conduct, and, through hypotheticals, offer suggestions as to how to navigate the DAC 6 requirements.

Presenters:

Delcia Capocasale advises clients on a wide range of Spanish and international tax matters, including the structuring of corporate transactions, fund formation, real estate transactions and cross-border investments, with a special focus on Spain and Latin America. She has extensive experience in negotiating with the Spanish tax authorities with respect to international matters. She also advises international private clients on wealth and succession planning, focusing on Latin American clients with Spanish interests.

Alan Winston Granwell advises clients on cross-border matters. In his private client practice, Mr. Granwell advises high-net-worth individuals on cross-border income, estate and gift tax planning, controversy and compliance, to include foreign persons becoming U.S. persons, and U.S. persons moving offshore or expatriating. Mr. Granwell is a former International Tax Counsel and Director, Office of International Tax Affairs of the US Department of the Treasury.

Kat Gregor regularly handles disputes with the IRS and other administrative bodies, and assists clients in managing disputes with non-US tax authorities. She represents public companies, private investment funds, institutional investors, private companies and high net worth individuals before the IRS, US Tax Court, US Court of Federal Claims and other federal and state courts.
